Arbitration Experience

  • Service on an ICC International Tribunal to resolve multiple large disputes arising out of construction of a gas fired power generation facility in the Middle East.
     
  • Service on an AAA Arbitration Panel to resolve sizeable health care disputes between a corporation and an entity of state government.
     
  • Chair of an AAA Arbitration Panel to resolve large value disputes between a construction contracting group and the design engineers on a sizeable road infrastructure project.
     
  • Chaired an ICDR Arbitration Panel on a dispute between a consortium of general contractors and a major subcontractor for additional work on a gas fired power generation facilities located on a large hydrocarbon refinery.
     
  • Served as Chair of an AAA Arbitration Panel for determination of a series of disputes between Joint Ventures on a large number of projects of significant value on military bases throughout the United States. Issued several written Interim Measures after evidentiary hearings enabling the parties to resolve their disputes.
     
  • Served as sole arbitrator on termination disputes under a Management Agreement for Construction of U.S. Government set aside projects throughout the country and rendered two reasoned awards on two separate disputes.
  • Served as Chair of an ICDR Arbitration Tribunal to resolve disputes arising out of the subcontract work on the construction of a USConsulate outside of the United States. After an evidentiary hearing with expert testimony, rendered a written itemized award.
     
  • Served again as Chair of another ICDR Arbitral Tribunal to resolve termination and completion disputes arising out of subcontract work on the construction of a different US Consulate outside of the United States. After an evidentiary hearing rendered a written reasoned award.
     
  • Served as Chair of an AAA Arbitration Panel for determination of intellectual property disputes arising out of a subcontractor agreement on the construction of US Military communication facilities throughout the world. After a lengthy evidentiary hearing rendered a written Interim Injunctive Relief which was upheld by both the applicable Federal District Court and US Court of Appeals.
     
  • Served as the sole arbitrator under ICDR Rules on a very large construction defect and warrantee dispute arising out of the furnishing and erection of sizable wind energy facilities with the parties ownership interests being from different countries. After a full evidentiary hearing with many experts, rendered a written reasoned award.
  • Served as the sole arbitrator in an ICDR Arbitration arising out of disputes between Joint Ventures constructing a high value facility in the Middle East for the US Military involving significant cost disputes. After a full evidentiary hearing with experts, rendered a written reasoned award.
     
  • Served on an Arbitral Tribunal for the London Court of International Arbitration on cost disputes between a very large prime contractor and a significant subcontractor from the Middle East with the Tribunal sitting in London arising out of very large service contracts for the US Military in the Middle East.
     
  • Served as the Chair of an AAA Arbitration Panel on significant design and construction defect disputes arising out of the construction of a biofuel plant in the United States. After a full and lengthy evidentiary hearing with expert testimony, rendered a written reasoned and itemized award.
     
  • Served as the AAA sole arbitrator on a construction defect dispute on a design-build contract arising out of the furnishing of a specialized sporting facility. After an evidentiary hearing, rendered a written reasoned award.
     
  • Served on an AAA arbitration panel to resolve significant monetary disputes on a service contract between a contractor and the public agency of a sizable city government. After a full evidentiary hearing, rendered a written reasoned award.
 

Mediation Experience

  • Mediator for numerous disputes between separate corporate entities and even governmental bodies.  Have assisted in arriving at settlements on disputes involving contract terms, factual differences to include alleged defective work and risk allocation sometimes involving secure military projects. 
  • Principal mediator for the Pennsylvania Avenue Development Corporation and the GSA, for the Ronald Reagan International Center project in Washington, D.C., the largest project in the capital since the construction of the Pentagon.
 

Dispute Resolution Board Experience

  • Listed as pre-approved for appointment to numerous Dispute Resolution Boards called for as part of Public Private Partnership (PPP) infrastructure road construction.
